PART ONE

Liability Waiver, Assumption of Risk, Media Release, and Refund Policy

By purchasing a ticket, registering for a class, checking the agreement box, submitting payment, signing electronically, or participating in any L'Elegance LLC class, workshop, event, online program, or in-person session, I acknowledge that I have read, understood, and voluntarily agree to the terms below.

1. Voluntary Participation

I acknowledge that I am voluntarily participating in classes, workshops, events, online programs, or in-person sessions provided by L'Elegance LLC.

I understand that L'Elegance LLC classes may include instruction related to etiquette, elegance, confidence, wellness, feminine presence, body language, non-verbal communication, movement, posture, walking, and walking in heels.

2. Assumption of Risk

I understand that participation in L'Elegance LLC classes and events may involve physical movement, including but not limited to standing, walking, posture practice, balance exercises, and walking in heels.

I understand that these activities may require physical exertion and may involve risks, including but not limited to discomfort, muscle soreness, loss of balance, falls, sprains, strains, injuries, or other physical harm.

I knowingly and voluntarily assume all risks, known and unknown, associated with my participation in L'Elegance LLC classes, workshops, events, online programs, and in-person sessions.

3. Health and Medical Responsibility

I understand that it is my responsibility to consult with a physician or qualified healthcare provider before participating in any class, workshop, or event if I have any medical condition, injury, concern, pregnancy, balance issue, pain, or physical limitation.

I represent that I am physically able to participate safely. I agree to listen to my body and to stop participating immediately if I experience pain, dizziness, discomfort, shortness of breath, emotional distress, or any condition that may affect my safety.

I understand that I am responsible for wearing appropriate footwear, clothing, and accessories suitable for the class or event.

4. Emergency Medical Assistance

In the event of an emergency, I authorize L'Elegance LLC, its instructors, representatives, staff, contractors, or event partners to seek emergency medical assistance on my behalf if they believe it is necessary.

I understand that I am responsible for any medical expenses, transportation costs, or related costs that may result.

5. Release of Liability

To the fullest extent permitted by New York law, I release and hold harmless L'Elegance LLC, its owners, members, managers, instructors, employees, independent contractors, assistants, representatives, agents, successors, assigns, event partners, venue owners, leaseholders, and affiliated parties from any and all claims, demands, damages, losses, liabilities, costs, or expenses arising out of or related to my participation in any L'Elegance LLC class, workshop, event, online program, or in-person session.

This release includes, to the fullest extent permitted by law, claims related to ordinary negligence. This release does not apply to claims that cannot legally be waived under New York law, including claims arising from gross negligence, reckless conduct, willful misconduct, or intentional wrongdoing.

6. Online and In-Person Classes

I acknowledge that L'Elegance LLC may provide both online and in-person classes, workshops, events, and educational materials.

For online classes, I understand that I am responsible for creating a safe environment for myself, including having enough space, wearing appropriate footwear, and avoiding participation on unsafe surfaces.

For in-person classes, I understand that I am responsible for following reasonable instructions from the instructor or event staff.

7. Educational Purpose and No Guaranteed Results

I understand that L'Elegance LLC classes are intended for educational, etiquette, wellness, confidence, elegance, personal development, and non-verbal communication purposes only.

I understand that etiquette, elegance, body language, flirting, communication, and personal presentation are subjective and may be interpreted differently by different individuals.

I acknowledge that L'Elegance LLC does not guarantee any specific personal, romantic, social, emotional, professional, financial, or relationship outcome as a result of participating in its classes, workshops, events, or programs.

8. No Medical, Psychological, or Therapeutic Advice

I understand that L'Elegance LLC does not provide medical, psychological, psychiatric, therapeutic, or mental health advice.

The information provided during classes, workshops, events, and programs is for educational and personal development purposes only and should not be considered a substitute for professional medical, psychological, therapeutic, or mental health care.

I understand that L'Elegance LLC and its instructors are not responsible for any emotional, psychological, personal, social, romantic, or professional outcome resulting from my participation or from my application of the skills taught.

9. Personal Belongings

I understand that L'Elegance LLC is not responsible for lost, stolen, or damaged personal belongings at any in-person class, workshop, or event.

10. Photo, Video, and Media Release

I grant L'Elegance LLC permission to photograph, film, record, and otherwise capture my image, likeness, voice, appearance, and participation during classes, workshops, events, and related activities.

I authorize L'Elegance LLC to use such photographs, videos, recordings, and other digital media for marketing, social media, educational, promotional, advertising, commercial, and business purposes, without payment, approval, or further notice.

I understand that these materials may be used in online and offline publications, including but not limited to websites, social media, email marketing, advertisements, course materials, and promotional content.

If I do not wish to be photographed or recorded, I understand that I must notify L'Elegance LLC in writing before the class or event begins.

11. Refund Policy

At L'Elegance LLC, we understand that plans can change, and we strive to accommodate our clients with fairness and care.

Refunds are available only when a written cancellation request is received by L'Elegance LLC at least 7 calendar days before the scheduled class, workshop, or event.

Cancellation requests received less than 7 calendar days before the scheduled class, workshop, or event are not eligible for a refund.

After the refund deadline has passed, L'Elegance LLC may offer a class credit at its discretion. Class credits, if granted, are subject to availability and must be used within 6 months from the original class or event date, unless otherwise approved in writing by L'Elegance LLC.

Certain fees, including booking fees, processing fees, transaction fees, or third-party platform fees, may be non-refundable.

Please see Part Three (Refund & Cancellation Policy) for detailed, program-specific refund tiers.

12. How to Request a Refund

To request a refund, please contact us in writing at least 7 calendar days before the scheduled class, workshop, or event.

Please include your booking details, including the name used for the reservation, the event date, and your contact information.

Once your refund request is received and approved, the refund process will be initiated. Please allow approximately 5–7 business days for the refund to be reflected in your account, depending on your bank, card issuer, or payment provider.

Refunds will generally be processed using the original method of payment. If this is not possible, L'Elegance LLC will work with you to find a suitable alternative.

13. Company Cancellation or Rescheduling

L'Elegance LLC reserves the right to cancel, reschedule, relocate, modify, or change the format, instructor, content, date, time, or venue of any class, workshop, or event.

If L'Elegance LLC cancels a class, workshop, or event, participants may be offered a refund, class credit, or transfer to a future class or event, as determined by L'Elegance LLC.

14. Agreement to Terms at Purchase

I understand that by purchasing a ticket, registering for a class, checking the agreement box, submitting payment, signing electronically, or participating in the class, workshop, event, or program, I am agreeing to this Liability Waiver, Assumption of Risk, Media Release, and Refund Policy.

I understand that my electronic agreement has the same legal effect as a handwritten signature to the fullest extent permitted by law.

15. Governing Law

This Agreement shall be governed by the laws of the State of New York.

Message and data rates may apply. Message frequency may vary. You may opt out at any time by replying "STOP," and you may request help by replying "HELP."

16. Acknowledgment

I confirm that I have read, understood, and voluntarily agree to the terms of this Agreement.

I understand that this Agreement includes an assumption of risk, release of liability, media release, and refund policy.

By completing my purchase, registration, electronic signature, or participation, I agree to be legally bound by these terms.

PART TWO

Terms of Service

Welcome to L'Elegance LLC ("L'Elegance," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of our website leleganceny.com (the "Site"), and any related services, content, classes, workshops, programs, or events offered by L'Elegance (collectively, the "Services").

By accessing or using the Site or Services, you agree to be bound by these Terms. If you do not agree, please do not use the Site or Services.

These Terms work together with, and do not replace, Part One (our Student Agreement), which applies specifically to your participation in any L'Elegance class, workshop, event, or program. Where the Student Agreement addresses a topic, that document controls for matters relating to class participation.

1. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to register for or purchase any L'Elegance program, class, or service. By using the Site, you represent that you meet this requirement.

2. Description of Services

L'Elegance provides educational content, coaching, mentorship programs, live and recorded classes, workshops, and in-person events related to etiquette, elegance, confidence, personal presentation, body language, and related topics, for educational and personal development purposes only.

We do not guarantee any specific personal, professional, romantic, social, or financial outcome from participation in our Services.

3. Account Registration and Purchases

Certain Services may require you to register, create an account, or provide personal information. You agree to provide accurate, current, and complete information, and to keep it updated.

All purchases made through the Site are subject to the pricing, payment terms, and refund terms stated at the time of purchase and in Part Three (Refund & Cancellation Policy). Payments are processed through secure third-party payment processors; L'Elegance does not directly store your full payment card details.

4. Intellectual Property

All content on the Site and within our programs — including but not limited to text, videos, curriculum, course materials, graphics, logos, the L'Elegance name and brand, and any original frameworks, methods, or teaching materials — is the property of L'Elegance LLC and is protected by copyright, trademark, and other intellectual property laws.

You may not copy, reproduce, distribute, resell, or create derivative works from our content without our prior written permission.

5. User Conduct

When using the Site or participating in our Services, you agree not to:

Violate any applicable law or regulation
Infringe on the intellectual property or privacy rights of others
Harass, abuse, or harm other students, staff, or instructors
Attempt to gain unauthorized access to our systems, accounts, or data
Use the Site or Services for any unlawful or fraudulent purpose

6. Third-Party Services and Links

Our Services may be delivered in part through third-party platforms (including but not limited to Circle, Zoom, and payment processors). Your use of those platforms may also be subject to their own terms and privacy policies, which we encourage you to review.

The Site may contain links to third-party websites. We are not responsible for the content, privacy practices, or terms of any third-party site.

7. Disclaimers

The Site and Services are provided "as is" and "as available," without warranties of any kind, whether express or implied, to the fullest extent permitted by law.

As detailed in Part One, L'Elegance does not provide medical, psychological, therapeutic, or mental health advice, and our classes are for educational and personal development purposes only.

8. Limitation of Liability

To the fullest extent permitted by New York law, L'Elegance LLC, its owners, members, managers, employees, instructors, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Site or Services.

9. Termination

We reserve the right to suspend or terminate your access to the Site or Services at our discretion, including for violation of these Terms, without prior notice.

10. Changes to These Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated "Last Updated" date. Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law principles.

PART THREE

Refund & Cancellation Policy

At L'Elegance New York, we understand that plans can change, and we strive to accommodate our students with fairness and care. This policy explains our refund, cancellation, and rescheduling terms across our different programs.

1. Elegance Refinement Mentorship (Basic, Elite, Elite VIP)

Refunds are available only when a written cancellation request is received by L'Elegance at least 7 calendar days before the scheduled start date of the mentorship program.

Cancellation requests received less than 7 calendar days before the program start date are not eligible for a refund.

After the refund deadline has passed, L'Elegance may offer a class credit at its discretion. Class credits, if granted, are subject to availability and must be used within 6 months from the original program start date, unless otherwise approved in writing.

Deposits paid for the Elite or Elite VIP tiers are non-refundable once the refund deadline above has passed, but may be applied toward a class credit at L'Elegance's discretion.

Certain fees, including booking fees, processing fees, transaction fees, or third-party platform fees, may be non-refundable.

2. New York Glow Up (In-Person, Multi-Day Experience)

Because the Glow Up is a scheduled, in-person, multi-day experience with limited capacity, the following refund tiers apply:

30+ days before the event: full refund, minus a non-refundable $100 deposit
14–29 days before the event: 50% refund
Within 13 days of the event: no refund; however, you may transfer your registration to a future Glow Up date within 12 months, subject to availability

Rescheduling to a future Glow Up date may only be requested once. A second rescheduling request will require purchasing a new registration at the then-current price.

3. Webinars and Masterclasses

Our live webinars and masterclasses (such as "How to Become Elegantly Phenomenal") are typically offered free of charge. Where a webinar or masterclass has a paid fee, purchases are final and non-refundable, as these are live, one-time experiences with no recording or replay available afterward.

4. Individual Coaching Sessions / One-on-One Packages

Cancellations or rescheduling requests made at least 48 hours before a scheduled individual coaching session will not count against your session package.

Cancellations or rescheduling requests made within 48 hours of a scheduled session will be counted as a completed session, unless due to a documented emergency, at L'Elegance's discretion.

Unused sessions within a coaching package must be used within 6 months of purchase, unless otherwise agreed in writing.

5. Online Courses and Recorded Content

All purchases of pre-recorded online courses, video content, downloadable materials, or digital products are final sale and are non-refundable, non-cancellable, and non-exchangeable, once access has been granted.

Access durations vary by course and will be clearly stated at the time of purchase.

6. How to Request a Refund

Please include your full name, the program or session you registered for, the date of purchase, and your contact information.

Once your refund request is received and approved, we will initiate the refund process. Please allow approximately 5–7 business days for the refund to be reflected in your account, depending on your bank, card issuer, or payment provider.

7. Company Cancellation or Rescheduling

If L'Elegance cancels a class, workshop, program, or event, affected participants will be offered a full refund, a class credit, or a transfer to a future class or event, as determined by L'Elegance.

8. Intellectual Property and Unauthorized Use

All materials, videos, curricula, worksheets, and content provided as part of any L'Elegance program are the property of L'Elegance LLC and are protected by copyright and other intellectual property laws.

Programs are intended for the registered individual only. Copying, sharing, reselling, recording, streaming, or distributing any L'Elegance course materials or session recordings without written permission is strictly prohibited and may result in legal action.

PART FOUR

Class Locations & Format Policy

1. In-Person Class Location

Our primary in-person location is:

L'Elegance New York — 135 West 50th Street, Suite 200, New York, NY 10020

This location is used for select in-person sessions, including portions of our New York Glow Up experience. Specific room details, arrival instructions, and building access information will be provided directly to registered students prior to the class date.

2. Traveling Glow Up Experiences

From time to time, L'Elegance may host Glow Up experiences or events in other cities (for example, Los Angeles, Miami, or San Francisco). Location details for any traveling event will be confirmed directly with registered students, typically 1–2 weeks before the event date, and may be subject to change based on venue availability.

L'Elegance is not responsible for travel, accommodation, or related costs incurred by students in connection with attending an in-person event.

3. Online / Virtual Classes

Our online mentorship sessions, webinars, and Elegance Lab practice sessions are conducted live via Zoom, with community access hosted on Circle (eleganceclub.circle.so).

Students are responsible for:

Ensuring a stable internet connection and access to the Zoom and Circle platforms
Creating a safe, appropriate space to participate, including adequate room to move for practice-based sessions (such as walking or posture exercises)
Wearing appropriate footwear and clothing, and avoiding participation on unsafe surfaces, as outlined in Part One

4. Right to Modify Location or Format

L'Elegance reserves the right to change the location, venue, room, or format (in-person to virtual, or vice versa) of any class, workshop, or event due to circumstances including but not limited to venue availability, weather, low enrollment, or matters of safety.

Where possible, students will be notified of any location or format change as soon as reasonably practical before the scheduled class.

5. Weather and Emergency Cancellations

In the event of severe weather, a declared emergency, or other circumstances beyond our control, L'Elegance may cancel, postpone, or move an in-person class to a virtual format. Affected students will be notified as soon as possible and offered a rescheduled date, virtual alternative, or credit in accordance with Part Three (Refund & Cancellation Policy).

6. Time Zones for International Students

L'Elegance welcomes students from around the world. All class times are listed in Eastern Time (ET/EST/EDT, New York, USA) unless otherwise noted. International students are responsible for confirming the corresponding local time for any scheduled session.

Consent to Receive Text Messages

By providing your phone number to L'Elegance New York ("L'Elegance," "we," "us"), you consent to receive text messages (SMS) and WhatsApp messages from us, including appointment reminders, class scheduling, program updates, student support, and — where you have separately opted in — promotional and marketing messages.

Message Frequency

Message frequency varies depending on your enrollment status, upcoming classes, and any promotions you have opted into. You may receive anywhere from a few messages per month to several messages per week during active class periods.

Message and Data Rates

Message and data rates may apply, depending on your mobile carrier and plan. L'Elegance is not responsible for any charges from your wireless carrier.

How to Opt Out

You may opt out of receiving text messages at any time by replying "STOP" to any message. After opting out, you will receive one final confirmation message, and no further messages will be sent unless you opt back in.

Carrier Disclaimer

2. Results & Testimonials Disclaimer

L'Elegance New York provides educational coaching, mentorship, and training related to etiquette, elegance, confidence, personal presentation, and related topics.

Any testimonials, before-and-after stories, or results shared on our website, social media, webinars, or marketing materials reflect the individual, personal experiences of specific students. They are not intended to represent or guarantee that any current or future student will achieve similar results.

Your results will depend on many personal factors, including but not limited to your individual effort, consistency of practice, starting point, and personal circumstances, which are entirely outside of L'Elegance's control.

L'Elegance does not guarantee any specific personal, professional, romantic, social, financial, or relationship outcome from participation in our classes, workshops, mentorship programs, or events. Our programs are educational and developmental in nature, not a guarantee of a specific life outcome.

Any statistics, figures, or statements referencing student outcomes are based on informal feedback shared by students and have not been independently verified or audited unless explicitly stated otherwise.

3. Affiliate Disclosure

L'Elegance New York may work with independent contractors, ambassadors, students, or partners who share L'Elegance programs using a personal affiliate link, and who may earn a commission on resulting enrollments or purchases.

If you encounter a recommendation, link, or promotion for L'Elegance from someone other than L'Elegance's official channels, that person may receive financial compensation if you make a purchase through their link. This does not increase the price you pay.

We require our affiliates and partners to disclose their relationship with L'Elegance in accordance with applicable advertising and endorsement guidelines, including those of the U.S. Federal Trade Commission (FTC).

4. Privacy Policy Addendum — California and International Visitors

California Residents (CCPA/CPRA)

If you are a California resident, you have the right to: (i) know what personal information we collect about you; (ii) request deletion of your personal information, subject to certain legal exceptions; (iii) correct inaccurate personal information; and (iv) opt out of the "sale" or "sharing" of your personal information.

5. Community Guidelines

L'Elegance students have access to our online community, hosted on Circle (eleganceclub.circle.so), and may participate in live sessions via Zoom. To keep this a warm, supportive space for all students, we ask that you:

Treat all students, instructors, and staff with kindness and respect
Refrain from harassment, discrimination, or disrespectful language of any kind
Keep shared content and discussions relevant to the community's purpose
Do not share, resell, or redistribute your access, login credentials, or course materials with anyone outside your own enrollment
Do not record, screenshot, or redistribute other students' shared personal stories, photos, or discussions without their consent

L'Elegance reserves the right to remove any content or restrict access for any student who violates these guidelines, at our sole discretion.
